Developer withdraws challenge to Winslow Neighbourhood Plan

A developer has withdrawn its legal challenge against the making of Winslow’s Neighbourhood Plan. Aylesbury Vale District Council made the plan, setting out the strategic vision for the town until 2031, in September 2014. But developer Gladman Developments Limited challenged the decision on a number of grounds, including the reasoning of the independent examiner who examined the plan and the lawfulness of the council’s decision to formally make the plan.

Gladman’s legal challenge to the making of the plan was dismissed in the High Court in December 2014. A subsequent appeal against that decision was made to the Court of Appeal in March this year. The council has now been informed that the developer has withdrawn from the Court of Appeal proceedings and is also no longer challenging the Secretary of State’s decision to refuse planning permission for a 211-home estate on land off Verney Road in Winslow.

Susan Kitchen, Manager, Development Management, said: “This is fantastic news for the residents of Winslow. A huge amount of work went into drawing up the plan by the Winslow community and the withdrawal of this challenge removes any doubt over the status of the plan when making decisions on planning applications in the area it covers."

“Although AVDC was confident that the Court of Appeal would dismiss this latest challenge to the plan, Gladman’s decision to drop the action is very welcome. We will be pursuing the recovery of our legal costs, where permitted.”

Neighbourhood planning was introduced under the Localism Act to give members of the community a more hands on role in the planning of their neighbourhoods. The Winslow Neighbourhood Plan was the first in the district to get to the referendum stage and was endorsed by the local community with a 98 per cent ‘yes’ vote.
